VxVM 4.X and 5200 on a EX500 , is license required ?

we are planning to reinstall and old 3500 we have over here with Solaris
10 , (or at least 9), these machine is connected to a A5200 which we
currently use, we are using VxVm 3.0.4 which works with the [photon]
license of the array, we want to upgrade VxVm to 4.1 (for solaris 10)
but we are not sure if the photon license will be there for our use, any
input is welcome.
