Thanks to Jenny Butler and Iain Barker for their answers

Jenny showed me the site for alpha firmware information;
http://ftp.digital.com/pub/DEC/Alpha/firmware/

Iain mentioned that moving a jumper to get the TIG to be loaded from
another location might work too. This is the solution that fixed our
problem. Details below.

I found this information the archive sight;
Power off the system, remove
the CPU/Memory cover, remove MMB1, then move jumper J21, which is the
upper
left jumper located to the upper right of MMB1, to position 2-3. This
jumper
position will force loading the TIG NVRAM from the serial rom. Leave the
jumper in this position. Replace MMB1, cover etc. and your TIG nvram
should
be fine hopefully forever).The jumper information is in the ES40 Service
Manual.

Subject: ES40 TIG error

ES40 4.0G

Managers,

An es40 died with TIG error and the recommendation is to update the
firmware. I cannot find my firmware cd so I need to know if there is a
way to burn or make one and where I can get the files for that?

TIA
