Use /etc/default/telnetd and set it up accordingly:
I use the following:
UMASK=022
BANNER="\n\n"
Use of this computer system, authorized or un-authorized,
constitutes consent to monitoring.

At least on Solaris 8, change the BANNER variable /etc/default/telnetd. We
have it set to "\n" which puts nothing on the screen. It could also be
coming
from your /etc/issue file so check there too.
